EARTHQUAKE –2001 Rehabilitation Package No.1 For earthquake affected.

Resolution :

On 26th January, the state of Gujarat was hit by an earthquake of a magnitude of 6.9 on the Richter scale according to IMD (US Geological Survey has put the magnitude at 7.7) causing colossal damage to life and property. 
The State Government has taken up the task of rehabilitation and reconstruction to facilitate resettlement and provision of shelter to the severely affected population. In order to enable those who were rendered homeless, the Government intends to assist them to re-build their houses and provide other infra-structural facilities in the affected areas, with the active support and co-operation of Industrial Houses, Voluntary Organizations, Public Sector Enterprises, other State Governments, National & International Institutions etc. Government intends to alleviate the hardship of the affected people, and enable them to reconstruct their houses, through a rehabilitation programme. The rehabilitation programme is not by way of compensation for loss undergone, but an earnest effort to provide succor and assistance. 
The rehabilitation programme has been evolved, in the form of four different packages by the Gujarat State Disaster Management Authority based on the recommendations of the Task force. The same was submitted to the State Cabinet for its approval. The Cabinet after full deliberation and due consideration has approved the packages.


Package No. 1

  1. Public-Private Partnership Programme(Re- location of villages)
    The State Government has declared package No.1 for the areas where the extent of damage is more than 70 %. The package provides for socio-economic rehabilitation of villages with infra-structural facilities.

  2. Re-location of completely damaged villages where the damage is more than 70 % will be taken up with full involvement of the villagers and with the consent of Gram Sabha. Where preference is for re-location, villages will be relocated in a suitable site near by the old village site preferably on the Government land and wherever the Government land is not available in a private land, which will be acquired under the Land Acquisition Act, 1894 by invoking the urgency clause or through mutual consent award. However if the village does not opt for relocation, then the provisions of Package 2 for in-situ rehabilitation will apply. 

  3. The planning and implementation of overall relocation and reconstruction will be executed with active participation of the affected families..

  4. Selection of village site will be made with the involvement of Gokul Gram Samiti or the Gram Sabha of the concerned village.

  5. Earthquake resistant infra-structural facilities will be developed in the new village sites. 

  6. Keeping in view the future growth of new village, adequate care will be taken and 15 % to 20% more land will be earmarked and reserved in the new site.

  7. The State Government through Roads and Building Department will provide lay out design, technical specifications, composition of material ingredients for the reconstruction. Buildings regulations and town planning rules will be strictly followed for construction of private and public buildings. The state government or the concerned authorities will( wherever necessary) lay down such regulations and rules.

  8. Approximate expenditure for establishing a village with 200 families and an average population of 1000 has been worked out as under :-

    1. Land requirement. : 12 hectares.
    2. The cost of land acquisition. : Rs.30 lakhs approximately.
    3. Primary infra structural facilities. : Rs. 50 lakhs approximately.
    4. The total cost of 7500 sq.mt. : Rs. 180 lakhs approximately. construction at the rate of  Rs.2400 per sq.mt.
    5. Provision for other incidental requirements. : Rs. 40 lakhs.

    In the new village site, the plot size and built up area will be divided in four distinctive categories as under :-

  9. 10 % of the cost of above 3 and 4 categories houses will be considered as interest free loan, which will be repayable in equal installments in 10 years with moratorium period of first two years.

  10. For reconstruction and rehabilitation, the voluntary organization, industrial houses, public sector enterprises can adopt villages or share the cost of reconstruction. The minimum contribution by NGOs(including corporates) and others will be 50% of the total cost.

  11. In case of total adoption of villages, such institution / organization will take up the work in consultation with and in accordance with the prevailing rules & regulations of the State Government.

  12. All the new buildings in the relocated site will be appropriately insured specifically covering earthquake risk.

  13. The package as illustrated above shall be subject to the conditions and procedure laid down as under :

    1. The owner/ actual possesor of the destroyed/demolished house will be eligible for the assistance under the package.

    2. In case where the dwelling unit occupied by a tenant(tenant as provided under Bombay Rent Act) has collapsed or has been pulled down for safety reason, the landlord of the house will be given assistance subject to the condition of putting back the tenant in possession soon after the reconstruction of the house..

    3. In case such residential building was being utilized for any non-residential purpose no assistance shall be given to the owner occupier of such house.

    4. The damage assessment will be carried by a team comprising of a government engineer, an official of Revenue/Panchayat and a representative of NGO/Headmaster if NGO is not working in village. The team in addition to filling up the sheet, shall also draw Panchnama. Photographs of each damaged house will be taken by the Survey Team for which Photographer will be engaged as per prevailing provisions.

    5. The survey from alongwith application of beneficiary will be filled up by the survey team and the signature of the affected beneficiary will be taken with an undertaking that in case of any particulars in the application is found false, the entire assistance will be surrendered.

    6. The survey form & other documents duly completed with the clear opinion of Survey team on extent of damage and quantum of assistance will be deposited with the Additional Collector/Collector for necessary further action.

    7. The measurement of built up area excludes Varandah and other peripheral structures. The measurement of built up area will be conducted by the Survey Team and opinion of the team will be treated as final.

    8. The beneficiary below poverty line is required to indicate his willingness for house under Indira Awas Yojana or Sardar Awas Yojana.

    9. All the building regulations and by-laws of appropriate authority, and earthquake standards & norms have to be strictly followed.

    10. In case of total re-location or partial re-location of building in the new site, the plot in the old site shall be transferred to the Government by the beneficiary. Such transfers shall be recorded in the village record / property card and will be maintained by the appropriate authority.

    11. The interpretation of any terms and conditions, regulations and category of assistance and damages shall lie with the State Government and the interpretations and decisions of the State Government shall be considered as final.

    12. All the expenditure will be booked under the major head : 2245-Natural Calamities and Relief, Major head: (2) Flood and Cyclone.
