Resolution :
On 26th January, the state of Gujarat was hit by an earthquake of a magnitude of 6.9 on the Richter scale according to IMD (US Geological Survey has put the magnitude at 7.7) causing colossal damage to life and property.
The State Government has taken up the task of rehabilitation and reconstruction to facilitate resettlement and provision of shelter to the severely affected population. In order to enable those who were rendered homeless, the Government intends to assist them to re-build their houses and provide other infra-structural facilities in the affected areas, with the active support and co-operation of Industrial Houses, Voluntary Organizations, Public Sector Enterprises, other State Governments, National & International Institutions etc.
Government intends to alleviate the hardship of the affected people, and enable them to reconstruct their houses, through a rehabilitation programme. The rehabilitation programme is not by way of compensation for loss undergone, but an earnest effort to provide succour and assistance.
The rehabilitation programme has been evolved, in the form of four different packages by the Gujarat State Disaster Management Authority based on the recommendations of the Task force. The same was submitted to the State Cabinet for its approval. The Cabinet after full deliberation and due consideration has approved the packages.The details of the Package No. 3 is as under :-

The completely destroyed house/hut means totally collapsed house and house/hut required to be pulled down for safety reasons.

The assistance will be disbursed to owner/actual possessor of
the property.

In case where the dwelling unit occupied by a tenant(as
provided under Bombay Rent Control Act.) has collapsed or has been pulled down for safety reason, the landlord of the house will be given assistance subject to the condition of putting back the tenant in possession soon after the reconstruction of the house.In case of repair, assistance will be disbursed to the tenant for carrying out the repair.

In case such residential building was being utilized
for any nonresidential purpose, no assistance shall be given to the owner occupier of such house.

The affected beneficiaries will be allowed to rebuild houses at the existing site. The Government will provide technical guidance, provide material specifications for building earthquake resistance building. The State Government will provide technical supervision.

The damage assessment will be carried by a team comprising
of a government engineer, an official of Revenue/Panchayat and a representative of NGO/Headmaster if NGO is not working in village. The team in addition to filling up the sheet, shall also draw Panchnama. Photographs of each damaged house will be taken by the Survey Team for which Photographer will be engaged as per prevailing provisions.

The survey form alongwith application of beneficiary will be filled up by the survey team and the signature of the affected beneficiary will be taken with an undertaking that in case of any particular in the application is found false, the entire assistance will be surrendered.

The survey form & other documents duly completed with the
clear opinion of Survey team on extent of damage and quantum of assistance will be deposited with the Additional Collector/Collector who shall scrutinize and release payment.

The measurement of built up area excludes Varandah and
other peripheral structures. The measurement of built up area will be conducted by the Survey Team and opinion of the team will be treated as final.

All the building regulations and by-laws of appropriate
authority, and earthquake standards & norms have to be
strictly followed.

The assistance will be disbursed at different stages of
construction in three installments. 40% of the assistance will be disbursed at preparatory level, 40% at the stage of lintel level of the construction and 20% after the completion of the construction. The last payment will be made on production of completion certificate.

All payments shall be disbursed by account payee cheques only. Collector/DDO/Addl.Collector/Addl.DDO shall make appropriate administrative arrangement for quick disbursement.

The interpretation of any terms and conditions, regulations and category of assistance and damages shall lie with the State Government and the interpretations and decisions of the State Government shall be considered as final.
All the expenditure will be booked under the major head : 2245-Natural Calamities and Relief, Major head: (2) Flood and Cyclone.
